8. Termination

8.3.
If the User Account is inactive for at least 365 days, Le Monde des Lutins may suspend the account.
9. Suspension of Access to Services
You acknowledge that Le Monde des Lutins may, at any time and without prior notice: 1- modify all or part of the Services;
2- to interrupt or suspend all or part of the Services if you fail to comply with the Terms of Use;
3- to refuse to process all or part of the Services, suspend or close your Member Area if, in the opinion of Le Monde des Lutins, you fail to comply with any of the provisions of the Terms of Use or at the request of a judicial or administrative authority.
10. Account Suspension / Account Cancellation
Your Account may be suspended if: - Your account has remained inactive for more than one year. If your account is suspended or closed, you may request that Le Monde des Lutins investigate this suspension or closure.
In this case, please contact our customer service. If you believe that your account has been suspended or terminated due to an error, you must contact Le Monde des Lutins by email. Any decision we make will be final.
You understand and agree that in the event of suspension, cancellation, or closure of your account, as described above, your right to access the Services will be terminated and no subscription fees will be refunded. Le monde des lutins may terminate your account at any time for any reason.
11. Conditions of Participation

The User acknowledges and accepts that Le monde des lutins assumes no liability to the User for any modification, unavailability, suspension, or interruption of the Site. No refunds will be issued in the event of service interruption.
13. Liability of Le Monde des Lutins
13.1.
Le Monde des Lutins undertakes to provide the Services with due diligence and professionalism, within the framework of an obligation of means.
13.2.
Le Monde des Lutins shall only be liable for the financial consequences of damages that are both (i) direct and (ii) foreseeable, resulting from improper performance or partial non-performance of the Service.
13.3.
Under no circumstances shall Le Monde des Lutins be liable for indirect or unforeseeable damages as defined in Articles 1150 and 1151 of the French Civil Code, which include, but are not limited to,
any lost profits, loss, inaccuracy or corruption of files or data, commercial loss, loss of revenue or profit, loss of customers, loss of an opportunity, cost of obtaining a substitute service or technology.
13.4.
In any event, (i) the amount of Le Monde des Lutins' financial liability is limited to the reimbursement of the User's subscription fees and earnings by Le Monde des Lutins, and (ii)
the User may only hold Le Monde des Lutins liable for any breach of these Terms of Use within one (1) year of the occurrence of the breach in question, which the User expressly acknowledges and accepts.
14. Force Majeure
14.1.
Le Monde des Lutins shall not be liable in the event of force majeure or any other event beyond its control that prevents the performance of its services and the provision of the Service in accordance with these Terms of Use.
14.2.
Events of an irresistible nature are considered force majeure, as well as that, without this list being exhaustive, the following events: total or partial strikes, internal or external to Le monde des lutins,
inclement weather, epidemics, blockages of means of transport or supply, for any reason whatsoever, earthquake, fire, storm, flood, water damage, governmental or legal restrictions, legal or regulatory changes to forms of
marketing, viruses, telecommunications blockages, including the switched network, terrorist attack.
15. French Intellectual and/or Industrial Property Rights
15.1. Reminder of the provisions of the Intellectual Property Code
15.1.1.
Art. L.335-2 CPI: “Any counterfeiting is a crime.” Any edition of writings, musical compositions, drawings, paintings, or any other printed or engraved work, in whole or in part, in violation of the laws and regulations relating to copyright,
is an infringement; and all infringement is a criminal offense. Infringement… is punishable by two years' imprisonment and a fine of €150,000.”
15.1.2.
Art. L.335-3 of the French Intellectual Property Code: “Any reproduction, representation, or distribution, by any means whatsoever, of a work of the mind in violation of the author's rights constitutes an infringement… Violation of any of the author's rights in software constitutes an infringement…”.
15.1.3.
Art. Article L.343-1 of the French Intellectual Property Code: "Infringing the rights of the producer of a database is punishable by two years' imprisonment and a fine of €150,000...".
15.2. Intellectual and/or Industrial Property Rights of Le Monde des Lutins
Le Monde des Lutins holds all intellectual and/or industrial property rights relating to the Site and/or the elements created and/or provided by it within the framework of the Service, as well as all documents and materials provided, where applicable, to the User within the framework of the provision of the Services,
regardless of their state of completion (hereinafter referred to as the "Creations"). As a Visitor and/or User, you agree not to reproduce any of the Site's elements.
Any unauthorized use of the Site would constitute infringement liable to civil and/or criminal prosecution. Furthermore, the User agrees not to use the Creations in any way that could infringe the industrial or intellectual property rights of Le Monde des Lutins.
16. Distinctive Signs
This term refers collectively to trademarks, company names, trade names, business names, domain names or URLs, logos, photographs, images, and/or other distinctive signs used on the Site or to designate the Services. Le monde des lutins is authorized to mention the User in its commercial documents or publications, only after the User has given written consent regarding the exact wording of the reference and its use, if this reference is more than simply mentioning the User's name.
17.2.
17.2.1.
The latest version of the Terms of Use accepted by the User constitutes the entire agreement between Le monde des lutins and the User relating to the Services and supersedes all prior statements, negotiations, commitments, oral or written communications, acceptances, contracts, and agreements relating to the provision of the Service by Le monde des lutins to the User.
17.2.2.
In accordance with Article 1369-1 of the French Civil Code, you can access the latest version of the Terms of Use that you have accepted at any time by accessing your User Account, and print them using [link to print terms]. the function offered by your browser.
17.2.3.
Any commitment made under additional stipulations or general terms and conditions whatsoever, even if signed by both parties, shall be null and void after the date of acceptance of the latest version of the Terms of Use by the User.
17.3.
Partial invalidity: In the event that any provision of the Terms of Use is deemed null and void or unenforceable by a final and binding court decision,
the parties agree to attempt to limit as much as possible the scope of this nullity or unenforceability so that the other contractual provisions remain in force and the economic balance of the Terms of Use is, as far as possible, maintained.
17.4.
Any notification (formal notice, report, approval, or consent) required or necessary under the provisions of these Terms of Use must be in writing and will be deemed validly given if delivered by hand or sent by registered mail with return receipt requested to the other party's postal address.
18. Governing Law and Jurisdiction

These Terms of Use are governed by French law, both procedurally and substantively.

If these Terms of Use are translated or presented on the Site in a foreign language, only the French version of the Terms of Use between you and Le monde des lutins will be considered valid.
18.3.
PURSUANT TO THE PROVISIONS OF ARTICLE Article 48 of the Code of Civil Procedure states that, in the absence of an amicable agreement between you and Le monde des lutins for any dispute relating to the interpretation, performance, or termination of this contract, jurisdiction is expressly conferred upon the French courts, which shall have exclusive jurisdiction, notwithstanding multiple defendants, and even for summary proceedings.
